LANSING, Mich. -

A county judge is calling for the withdrawal of city of Detroit's bankruptcy filing, WDIV in Detroit reported.

Ingham County Judge Rosemarie Aquilina said the Chapter 9 filing on Thursday violates the state constitution and state law, the TV station reported.

The city's two pension boards have filed a lawsuit to try and block the filing, fearing that the city will slash pension benefits.

Aquilina said Gov. Rick Snyder must order Emergency Manager Kevyn Orr to withdraw the filing and make sure he does not authorize any more filings which threaten "to diminish or impair accrued pension benefits."

WDIV reported that Attorney General Bill Schuette is appealing the judge's ruling on Snyder's behalf.
