After having his murder conviction overturned, Dale Larkin has been released from prison.
Larkin was originally sentenced to life in prison in 2011, after being convicted of first degree murder in the death of his wife, Terri.
She was found dead in a bathtub in 2003 and it was initially ruled an accident.
But the victim's family kept pushing investigators and a second autopsy in 2009 revealed broken bones which led to charges against Dale Larkin.
The Appeals Court says the court made errors several times during the trial, including not sequestering the jury and allowing a defense expert witness to switch to the prosecution.
We’re told Larkin was released on a $100,000 bond.
